California Surrogacy Laws: What You Should Know
To ensure your journey is legally solid, here’s a snapshot of how California handles surrogacy, plus what ACRC does to anchor you in that legal protection.

Pre‑Birth Orders: California allows intended parents to get legal parental rights before birth, even if the surrogate is not genetically related, or if the intended parents are unmarried or LGBTQ+.

Surrogacy Agreements: These are legally binding contracts. They outline rights, responsibilities, compensation, medical care, schedule, etc. Each party has independent legal counsel.

Protections for Surrogates: Laws ensure surrogates have medical oversight, the right to make choices about their care and health, and clear agreements about compensation and expenses.

No Residency Requirement: You do not need to live in California to engage in a surrogacy arrangement here. Many international intended parents use CA’s legal framework for its clarity.
Is a Pre-Birth Order Possible If No Party Lives in California?
Yes!
Under CA Family Code, Section 7962(e), a pre-birth order can be filed in several counties, including:

The county where the child is expected to be born

The county where the intended parent(s) reside

The county where the surrogate resides

The county where the surrogacy agreement was signed

The county where any medical procedure (related to the agreement) will occur
This means that even if neither the surrogate nor the intended parents live in California, as long as the child will be delivered in California or another listed criteria is met, you can take advantage of California’s surrogacy protections.
